1. Overview & Service Scope
MailCheap (accessible at https://mailcheap.email) is a newsletter publishing, subscriber management, and email campaign platform. These Terms of Service govern access and use of our infrastructure by all creators, companies, and users ("User" or "Customer").
2. Account Creation & Security
Access requires verification of a valid email inbox via secure one-time passcode (OTP) or Google OAuth. Users remain solely responsible for maintaining inbox security and all activities conducted through their workspace. Any suspected unauthorized access should be reported immediately to newsletter@mailcheap.email.
3. Acceptable Use & Anti-Spam Compliance
MailCheap maintains zero tolerance for unsolicited bulk email (spam). Every user strictly agrees to:
- Only import and message recipients who have explicitly consented (verifiable opt-in).
- Never upload purchased, rented, scraped, or third-party lead lists.
- Maintain spam complaint rates below mailbox provider thresholds (e.g. Gmail/Yahoo < 0.10%).
- Include functional one-click unsubscribe links in all outbound campaign broadcasts.
Violations may result in immediate suspension or termination of sending privileges without refund.
4. Fair Send-Based Pricing & Billing
MailCheap operates on a fair usage pricing structure: billing is determined strictly by the actual number of emails sent per month rather than total subscriber list size. There are no penalty fees for storing inactive contacts. Any sending exceeding plan quotas is billed transparently at published incremental rates.
5. Data Ownership & Protection
Users retain 100% ownership of their contact lists, broadcast content, and published archives. MailCheap does not sell, lease, or monetize customer data. All databases and network channels comply with modern encryption and security best practices.
6. Service Availability & Deliverability
MailCheap uses redundant sending infrastructure to maintain high service availability. However, final inbox placement depends heavily on the sender domain's reputation, subscriber engagement, and recipient mail filters.
7. Account Cancellation
Users may export their data and cancel or delete their accounts anytime through the dashboard settings or by contacting our team.
